Bhaliaguda Fake Encounter: Mass Protest in Berhampur, Odisha

Berhampur, 15th November, 2018; After the 6 years of Bhaliaguda Fake Encounter (14th November, 2012), the family members of the victims yet to get justice, where 5 tribal and dalits were brutally killed by the security forces at Bhaliaguda forest, the bordering area of Kandhamal-Ganjam and Gajapati District. The innocent tribal and dalit youths were killed by the security forces in a so called encounter with the Maoists, to satisfy their Big Boss and the Political Ring Masters. But they all were common man and living a common life within the society with their family members. But they killed due to their protest and movement against corruption at Panchayat and Block level.

When since last 6 years, two mass organizations like Campaign Against Fabricated Cases (CAFC), Odisha and Banabasi Surakhya Parisada, Kandhamal continuing the campaign both in legal and democratic level, demanding justice to the family members of the deceased , no justice has been achieved yet by the so called pro people government machinery or judiciary. Still the struggle is going on.

Hundreds of tribal and dalits from Kandhamal and neighbouring Ganjam and Gajapti district organized a procession from Kamapalli Chhak and demonstrated before the RDC Office, Berhampur.A Protest meeting was organized and facilitated by Narendra Mohanty, the State Convener of CAFC, Odisha and speakers like CPI(M) leader Kailash Sarangi, leader of CPI(M.L)- Red Star Sankar Sahu, Pramod Rath, leader of CPI(M.L)- New Democracy Pratap Pradhan, Balabhadra Mallick from Banabasi Surakshya Parisada, Bijaya Swain from Chasi Adhikar Sangram Manch, widow wife of late Ghasiram Bagsing and others spoke in the meeting. The widow wives of four deceased Laxmi Bagsingh, Mamita Pradhan, Ranjita Patamajhi and Sikaalu Majhi along with Narendra Mohanty was submitted memorandum to the Governor and Chief Minister through the Secretary of RDC. A Letter of Petition has also sent to the Chief Justice of Supreme Court praying the intervention to the matter to get justice.


That, the deceased youths belonged to poor adivasi and dalit families from various places of Kandhamal district. The victims were actively involved in the activities related to issue like forest rights, MGNREGA, RTI and were never involved in any other illegal activities. Among the deceased ones – Aiba Pradra of Bujuli Village, Syamson Majhi of Bhinguruguda and Ghasiram Bagsingh of Mardipanka village under Brahmanigam Police Station are well known for their social activities. Ghasiram Bagsingh was elected Samiti Sabhya of Saramuli. On August 19, 2012 under the leadership of Ghasiram and Syamson Majhi, a group of people lodged FIR at Brahmanigam police station against Smt. Kamala Patamajhi, the then Sarapanch of Saramuli G.P. and her husband Sri Karma Patamajhi, the Ex. Sarapanch along with their family members for they were illegally transporting BPL rice. 


In this connection a case was registered at Brahmanigam P.S and the police seized rice and arrested the driver. Later on 10th October 2012 Smt. Kamala Patamajhi, Sarapanch, was arrested and sent to jail whereas her husband was granted anticipatory bail from the Odisha High Court.

But deceased Ghasiram Bagsingh and Syamson Majhi with more than hundred people staged a dharana in front of Daringbadi Block office on 11th Oct, 2012 demanding immediate arrest of all involved family members involved with the crime. Aiba Padra played a vital role for the implementation of MGNREGA & Forest Right Act in Gadapur and Hatimunda G.Ps. He also supported to that people’s movement against illegal sale of BPL rice by Sarapanch and her family.  


It is to be noted that Karma Patamajhi Ex-Sarapanch of Saramuli and the husband of Smt. Kamala Patamajhi, the then Sarapanch, Saramuli got defeated by Aiba Padra’s uncle Sri. Luko Sunamajhi in 2012 Samiti Sabhya election from Gadapur G.P. Karma Patamajhi and his family members threatened to kill them for disclosing the BPL rice scandal and other political differences. 


 Apprehending the danger to their life they had lodged on FIR to Brahmanigam Police Station under Kandhamal.  It is known that the deceased persons were summoned by the Maoists to Bhaliaguda to face the ‘Praja Court’ (People’s Court). Accordingly out of fear to Maoists, the said three persons had reached the Maoist camp via Mohana and after giving their reply they were returning while they were shot dead by the firing of S.O.G and Police. Likewise Mr. Sanatan Mallik of Gaheju village and Mr. Lakshmikanta Nayak of Tikabali area, two innocent tribal & dalit person belongs from labour class was also shot dead by police action. Like any other ‘law-abiding’ citizen, they were afraid of both Maoists and the Police. The Police could have arrested them and sent them to jail, if they were involved in any criminal activities. 


Several mass democratic organisations and civil rights groups such as ‘Campaign Against Fabricated Cases, Odisha,’ ‘Adivasi Manch, Kandhamal’, ‘Banabasi Surakshya Parishad, Kandhamal’, ‘Sarvodaya Samaj, Odisha, Coordination of Democratic Rights Organisations (CDRO), Human Rights Front  and many credible human rights activists, who have visited the area and collected facts, have clearly proved that there were neither any crossfire, nor the deceased ones had any weapons with them and the poor fellows were trapped and killed cold-bloodedly.


Since last five years, the victim families are moving and knocking the doors of various important persons of the State Administrations like Chief Minister, Ex-Governor and Collector of Kandhamal to get justice. But till the yet they have not able to get justice. Even after the letter by the Honourable Ex. Governor of Odisha (No.Pl-58/2013 & Memo No.1789/SG (Ptn) Dated 24/06/13) to the Collector of Kandhamal regarding to inquire the matter and taking of appropriate action did nothing for them. Even no steps have been taken, though they have organized a peaceful dharana before the District Collector and submitted memorandum to your honourable office on 14th November of 2013, again submitted memorandum to the Governor, Odisha on 14th Nov, 2014, organized a protest send a memorandum to you on 14th Nov, 2015 through RDC, Berhampur, protest at Bhubaneswar on 15th November, 2016, protest at Bhubaneswar on 18th November, 2017 and protest before RDC, Berhampur and submitted memorandum on 15th November, 2018. 


In this context, the people along with the family members of deceased persons under the banner of Campaign Against Fabricated Cases (CAFC), Odisha have gathered after six years of incident at Berhampur, before the RDC, Southern Zone and putted following demands.


1. Independent and Impartial Inquiry into the incident of Bhaliaguda Fake Encounter. 

2. Lodge FIR under section IPC 302 against the murderer police.

 3. Stop police atrocities against the common villagers in the name of combing operation.

 4. Sanction compensation of Rs. 50 lakhs for each deceased family.
