FACT FINDING REPORT OF CDRO

The Judicial Inquiry Must Be Conducted on Thadiballa Encounter

The Government is recently changed in Chhattisgarh State, but the policy of repression on Adivasis is intact. Raman Singh Policy impressions of killing innocent people are being perpetrated by Bupesh Bagel Government. The Home Minister of Chhattisgarh congratulated the police forces who massacred 10 innocent Adivasis on 7th February 2019 and declared as Maoists have been gun down in an encounter. The forces were given total freedom to kill Adivasis in the pretext of combating leftwing extremism. The total immunity is granted to the police forces for all their illegal and unconstitutional acts. 

The encounter that purportedly held on 7th February 2019 at Thadiballa Village, Bhairamangadh block, Bijapur District, Chhattisgarh State was a sheer fake encounter. There was no exchange of fire reported between the Maoists and the police forces. Neither the police nor the Maoists were killed or injured in the encounter evidence that encounter was not taken place at all. Every exchange of fire may result in loss of life or injury to the parties. No such manifestations reported in the media, instead, media reported that the police have confiscated 11 barman rifles, one 315 revolver, and Improvised Explosive Devices. The antecedent of this has to be investigated. The suppression of material facts to distract the courts is a crime. The fact is, the police forces have taken 10 Adivasis into custody, tortured brutally and killed in cold blood on 7th February, 2019.

The Coordination of Democratic Rights Organization (CDRO) has constituted a fact-finding team comprising Association for Protection of Democratic Rights (APDR), West Bengal, Committee for Protection of Civil Liberties (CPCL) Tamil Nadu, Jharkhand Committee for Democratic Rights (JCDR) Jharkhand, Civil Liberties Committee (CLC) Andhra Pradesh, Civil Liberties Committee (CLC) Telangana, which ascertained the facts pertaining to Thadiballa encounter by visiting the place of incident and interacting with victim families and other Adivasis in the area on 23rd February, 2019 are presented below.

The Adivasis has presented to our fact-finding team that the Maoists were organizing a camp of some activities for a couple of days before encounter took place of 7th February 2019 in the thick forest area of Thadiballa Village, Bhairamangadh Block, Bijapur District, Chhattisgarh State. Therefore, on 7th February 2019 Adivasis from nearby villages consisting of women, children, adolescents and males from nearby villages have gone to that camp just to watch the programmes. They also went there to appraise of their problems to the Maoists. While discussing their problems all of the sudden police in large number, were seen surrounding them. The police were able to reach the place with the help of well-established informer network.

The moment when Maoists have spotted the police forces approaching their camp, they immediately alerted the Villagers to leave the spot and they also escaped into the forest. However, some of the Adivasis were able to escape into the forest, whereas 10 Adivasis were trapped by the police. All of them were brought to the place of the Maoist camp and severely beaten with sticks, brutally tortured and were killed. The police have severed the nose, ears, and breast of women by name Oyam Sudhri and then killed. The Adivasis who were able to escape and hiding in the bushes stand as the eyewitnesses to the torture and killing of 10 captive Adivasis. The killed include 5 women and 5 male inclusive of teenagers.

1. Madvi Vijjo 14years, Female; 

2. Kadiyam Shankar 13years, Male; 

3. Barasa Sukku 21years, Male; 

4. Parsa Sukku 18years, Male; 

5. Oyam Sudhri 17years, Female; 

6. Oyam Raju 21years, Male; 

7. Barasa Paramesh 24years, Male; all belonging to Uthala Village

8. Arki Shanthi 17years, Female; Kolnar Village; 

9. Barasa Somri 15years, Female; Chotepalli Village and; 

10. Sodi Palo 22years, Female: Thadiballa Village.

                   Ironically, the Home Minister congratulating the police forces who killed the Adivasis demonstrates the policy of present Congress Government towards Maoists party and repression on Adivasis. The people of Chhattisgarh voted Congress to power as they vexed up with the repressive policy of the BJP. But the Congress continuing the same policy of unleashing the same repression on Adivasis. Therefore, the Congress Chief Minister Bupesh Bagel raised the carton of unleashing repression by killing 10 Adivasis after assuming power. The police killed Adivasis only for accomplishing the given target. The police have carried out this saga of fake encounter only to assert their domination in the Abuzmad Forest Area.

Demands:

  1. Fake encounters should be immediately stopped.
  2. The police responsible for killing should be booked under 302 section and be punished.
  3. The police should be booked under SC/ST Atrocities Act. 
  4. The judicial inquiry should be conducted by the sitting judge of the Supreme Court. 
  5. Withdraw the police camps from Adivasi habitats.
  6. The policy of operation Samadhan must be withdrawn immediately.
